(d/b/a: InventionHome), you (the “user” or “you”) agree to be bound by the following terms and conditions (the “Terms of Service” or the "Agreement"), including those available by hyperlink. Before you may become a subscriber of SubmitMyInvention, you must read and accept all the terms and conditions in, and linked to, the Agreement. This Agreement is effective upon acceptance for new users. SubmitMyInvention’s terms of service may be updated from time to time. SubmitMyInvention will notify you by email if material changes are made to the agreement. SubmitMyInvention provides corporate subscribers with a web-based submission management system to help manage product / invention submissions quickly and easily, online. The system is designed to create a centralized, online submission site, which streamlines how information flows into a company, while consolidating all submission information into an online database for quick and easy access and management. Furthermore, the system offers a simplified follow up process by providing automatic email responses generated by the system at three distinct points in the process; 1. upon submission 2. upon review of the submission and 3. upon decline of submission. Finally, the system offers a consistent viewing format and the ability to share submissions with other internal decision makers.
Registration Data and other invention related information collected through the system is subject to our Privacy Policy. For more information, see our full privacy policy at Privacy Policy. You understand that through your use of the Service you consent to the collection and use (as set forth in the Privacy Policy) of this information.
SubmitMyInvention is offered free of charge to InventionHome partners and affiliates who desire to streamline the process of collecting and managing online submissions. SubmitMyInvention is free for you, the company, to use, in exchange for a mention or referral to InventionHome to those submissions that are collected via the service and are declined by you.
SubmitMyInvention recognizes the sensitivity of offering a resource recommendation to inventors or companies that submit new products or inventions. As a result, SubmitMyInvention has created a seamless contact management process and policy to manage inventor referrals appropriately and professionally.
Exception - If you specify in your Set Up / Manage Account section under Submission Criteria that you do NOT want to receive submissions without patent protection, the online submission form will display a note to the submitter that does not have patent protection. The note will explain that patent protection is required for submissions and it will offer a link to InventionHome for assistance. The note is displayed on the third page of the submission form when a submitter selects the “NO PATENT” option under the patent status drop down box.
Eligibility: You must be a legal business entity with a public, corporate website which includes a link that points to the “SubmitMyInvention” website established through our service.
Password: You will receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify SubmitMyInvention of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. SubmitMyInvention cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.
Account Information: You must keep your account information up-to-date and accurate at all times, including a valid email address.
SubmitMyInvention is a free web application / service of InventionHome, which can be terminated at any time by disabling the “SubmitMyInvention” link from your website.
SubmitMyInvention does not claim ownership rights in any Content posted to the system. You agree to allow SubmitMyInvention to store all Content submitted to you through the SubmitMyInvention system. SubmitMyInvention will only use personal information in accordance with the SubmitMyInvention Privacy Policy.
SubmitMyInvention, and other SubmitMyInvention graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks, trademarks or trade dress of Jacob Enterprises, Inc. in the U.S. and/or other countries. SubmitMyInvention’ trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion.
SubmitMyInvention may contain robot exclusion headers, which contain internal rules for software usage. Much of the information on SubmitMyInvention is updated on a real-time basis and is proprietary to SubmitMyInvention. You agree that you will not use any robot, spider, scraper or other automated means to access SubmitMyInvention for any purpose without SubmitMyInvention’s prior express written permission. Additionally, you agree that you will not: Copy, reproduce, modify, create derivative works from, distribute or publicly display any user from the System without the prior expressed written permission of SubmitMyInvention or Interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site.
Except as provided in SubmitMyInvention’s Privacy Policy, SubmitMyInvention will not sell or disclose any information contained within the system (as defined in the Privacy Policy) to third parties without your explicit consent. SubmitMyInvention stores and processes content on computers located in the United States that are protected by physical as well as technological security.
SUBMITMYINVENTION, SUBMITMYINVENTION’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS PROVIDE SUBMITMYINVENTION’S WEB APPLICATION AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. SUBMITMYINVENTION, SUBMITMYINVENTION’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, NO ADVICE OR INFORMATION (ORAL OR WRITTEN) OBTAINED BY YOU FROM SUBMITMYINVENTION SHALL CREATE ANY WARRANTY. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.
IN NO EVENT SHALL SUBMITMYINVENTION, AND (AS APPLICABLE) SUBMITMYINVENTION’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SITE, SUBMITMYINVENTION’S SERVICES, OR THIS AGREEMENT, INCLUDING WITHOUT LIMITATION, LOST PROFITS, BODILY INJURY, EMOTIONAL DISTRESS, OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. SUBMITMYINVENTION’S LIABILITY, AND (AS APPLICABLE) THE LIABILITY OF SUBMITMYINVENTION’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO SUBMITMYINVENTION FOR USE (ZERO) PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $100. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
YOU AGREE TO INDEMNIFY AND HOLD SUBMITMYINVENTION AND (AS APPLICABLE) SUBMITMYINVENTION’S PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.
SubmitMyInvention does not guarantee continuous, uninterrupted access to the System, and operation of the System may be interfered with by numerous factors outside SubmitMyInvention’s control.
You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of SubmitMyInvention’s system.
If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.
You and SubmitMyInvention are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
SubmitMyInvention reserves the right to modify or terminate the SubmitMyInvention service for any reason, without notice, at any time. SubmitMyInvention reserves the right to alter these Terms of Use or other Site policies at any time. If the alterations constitute a material change to the Terms of Use, SubmitMyInvention will notify you via email to the email address in your account. What constitutes a "material change" will be determined at SubmitMyInvention’s sole discretion, in good faith, and using common sense and reasonable judgment.
This Agreement shall in all respects be interpreted and construed with and by the laws of the State of Pennsylvania and disputes arising under this Agreement will be adjudicated by the courts of the State of Pennsylvania.
Except as explicitly stated otherwise, any notices shall be sent by postal mail to Attn: SubmitMyInvention, 275 Center Road, Suite 105, Monroeville, PA 15146-1451 or, to the email address you provide to SubmitMyInvention (either during the registration process or when your email address changes). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, SubmitMyInvention may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to SubmitMyInvention. In such case, notice shall be deemed given three days after the date of mailing.
